Destruction of Records Of Students With Disabilities
In accordance with the state and federal regulations implementing The Individuals with Disabilities Education Act (IDEA), this notice is to inform you of Gwinnett County School District’s intent to destroy records containing personally identifible information related to special education services maintained on students who received special education services under an Individualized Education Plan while attending Gwinnett County Public Schools.
Records to be destroyed include:
- Individualized Educations Plans (IEPs)
- Evaluation Reports – Test Protocols
- Notice of Action
- Review of Existing Data Summaries
- All other personally identifiable information within the Special Education file
The reason for destruction of the above listed items is because they are no longer needed to provide educational services.
*The district may maintain a permanent record, without time limitation, of a student’s name, address and phone number, his/her grades, attendance record, classes attended, grade level completed, and year completed.
Records for students with a disability who became inactive (withdrew or graduated) from any school in the Gwinnett County School District during the following school years are no longer needed for educational purposes.
- High School - graduated or withdrew during school years: 2014/2015 and Prior
- Middle School – withdrew during school years: 2011/2012 and Prior
- Elementary School – withdrew during school years: 2005/2006 and Prior
These records may be useful to the student for Social Security or other reasons. The system plans to destroy these records on or after November 1, 2025 unless there has been a request for a due process hearing (under the reauthorized IDEA) or a complaint filed with the Civil Rights, under section 504 of the Rehabilitation Act of 1973.
